Court approves receiver manager for Comfort Vegetable Oil

The Federal High Court, Abeokuta has ordered Chief Robert Ohuoba to be the receiver manager of Comfort Vegetable Oil Limited.The order followed an ex-perte application filed by the plaintiff, ETI Specialised Resolution Company Limited against the defendant, praying the court to so hold.

The court also granted leave to Ohuoba to take over and preserve all the fixed and floating assets of the defendants in every location within the jurisdiction of the court.

“The respondent, its directors, stakeholders, employees, officers, agents, privies or any person or group of persons are hereby restrained from obstructing the 1st applicant who is the receiver of the respondent appointed by the 2nd applicant to preserve and manage the assets of the respondent at KM3, Atan-Sokoto Road, Atan Ota, Ogun State and other traced location,” the court held.

The respondents and or their agents were also restrained from operating or tampering with the funds in the respondent’s bank account under whatever name or guise in any bank or financial institution in Nigeria.

In addition, all banks or financial institutions in Nigeria were directed to furnish the appointed receiver details of any sum standing to the credit of the defendant within seven days of being served the interim order.

While the Police were directed to assist Ohuoba in the course of the performance of his lawful duties and responsibilities over all the assets, the receiver manager were granted leave to author the mandatory statutory and procedural notices as may be deemed fit in any national circulated newspaper in Nigeria.
