A Lagos High Court, sitting at TBS, Lagos, has adjourned the case between Lagos State government and Private Sector Participation (PSP) Waste Operators, to allow for settlement.

The court took the decision after counsel to the State Government confirmed to the court that the proposed term of settlement was ready to be delivered to the PSP.

The PSP and Lagos government had involved in a legal battle over attempt by the government to exclude the PSP Waste Operators from domestic waste collection and disposal under the Cleaner Lagos initiative.

At the resumed hearing of the suit before Justice Oyekanmi Abdullahi, counsel to the indigenous PSP Waste Operators led by David Fadile told the court that in line with the submissions of the parties to the court at its last sitting on the matter, “our clients has sent their proposed terms”.

He said: “Our clients have since sent their proposed terms of settlement to the government and were waiting for its response for harmonization, which would be laid before the court for adoption as the terms of settlement.”

He also told the court that counsel to the government had informed them that their terms of settlement was ready and would be forwarded to them.

Fadile requested for a short adjournment, stating that if the defendant accordingly send in its proposals as promised, the parties would have to meet to review it and agree on the terms before bringing it to the court for adoption.

However, lead counsel to Lagos Government in response, confirmed that the defendant’s proposed terms of settlement was ready and assured the claimants that they will get it shortly.

In her ruling, Justice Abdullahi said: “The court will view the submissions for settlement and the harmonization by the parties. I am delighted to adjourn this matter to the 19th and 20th of December 2017 for the terms of settlement, which will be duly filed before the court”.
