IPOB members ask court to quash charges
Members of the Indigenous Peoples of Biafra (IPOB) on Wednesday asked a magistrate’s court sitting in Enugu to strike out the criminal charges filed against them by the Police.
The accused persons, numbering 27, told the court through their counsel, Emeka Ugwuonye that the police have not shown diligence in prosecuting their matter.
The accused, were said to have been arrested when they gathered to hold prayer sessions for the release of their leader Nnamdi Kanu, who is currently facing trial.
The pro-Biafra activists, who had earlier been arraigned and granted bail by the presiding magistrate Paulson Egbo, re-appeared in court yesterday for continuation of hearing.
However, the matter could not be heard as the prosecutor, D.I Ogbu
Informed the court that he was yet to obtain the consent of the
attorney-general of Enugu State to prosecute the matter.
Consequently, counsel to the accused, in praying the court to discharge them, stated that they cannot “wait indefinitely for the attorney general’s consent. He therefore, sought for an adjournment to enable him obtain his consent stating that, “the right of the accused persons has to be protected by the court since the prosecution has failed to do the needful.”
