Terms and conditions of use

Welcome to the Guardian Newspapers Limited (GNL) website (the “Site”). By accessing and browsing the Site or by using and/or downloading any content from the Site, you agree and accept the Terms of Use (“Terms”) as set forth below. 

All the materials contained on the Site are provided for informational purposes only and shall not be construed as a commercial offer, a license, an advisory, fiduciary or professional relationship between you and GNL (“GNL” or “we” or “us”). No information provided on this Site shall be considered a substitute for your independent investigation. The information provided on this Site may be related to products or services that are not available in your country.

The use of this website is subject to the following Terms:

  • Copyrights:  All content and functionality on the Site, including text, graphics, logos, icons, and images and the selection and arrangement thereof, is the exclusive property of GNL or its licensors and is protected by Nigeria and/or international copyright laws.  All rights not expressly granted are reserved.
  • Trademarks:  All trademarks, service marks, designs, layout, look, appearance, graphics and logos (collectively, the “Trademarks”) displayed on this Site are the registered and unregistered Trademarks of Guardian Newspapers Limited, its licensors or any other applicable party in any public medium (e.g. press release, websites) for advertising or promotion purposes, or for the purpose of informing or influencing any third party and that you will not use or reproduce any Trademark of, or imply any endorsement by or relationship with, GNL or its licensors.
  • Use of site content:  GNL hereby grants you a non-exclusive, non-transferable license for the term hereof to access and download, display, and print the content and functionality displayed on this website (the “Site Content”) solely for your personal use, provided that you do not modify the Site Content in any way and that you retain all copyright and other proprietary notices displayed on the Site Content.  You may not otherwise reproduce, modify, distribute, transmit, post, or disclose the Site Content without Guardian Newspapers Limited’s prior written consent. Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offense.
  • User postings:  GNL prohibits the posting of any information that infringes or violates the copyright rights and/or other intellectual property rights (including rights of privacy and publicity) of any person or entity.  GNL does not and cannot review all information posted on the Site by users and is not responsible for such information.  However, GNL reserves the right, in its sole discretion, to remove any information (including, but not limited to, user postings that are threatening, libelous, defamatory or obscene or contain unsolicited advertising, a computer virus or the like), in whole or in part, for any reason or for no reason.
  • DISCLAIMERS: While GNL will use reasonable efforts to provide reliable information through the Site, your use of any information or materials on the Site is entirely at your own risk, for which GNL shall not be liable.  All content and functionality on the Site is provided “As Is”, without warranty of any kind, either express or implied, including, without limitation, implied warranties of merchantability and fitness for a particular purpose.  GNL and its third-party content providers make no warranties, express or implied, as to the ownership, accuracy, timeliness, performance or adequacy of the Site Content.  GNL shall have no liability or responsibility for any information published on linked websites, contained in any user submissions published on the Site, or provided by third parties.  Neither GNL nor its third-party content providers shall be liable for any indirect, incidental, consequential, or punitive damages or for lost revenue or profits, business interruption or loss of data arising out of or in connection with the use, inability to use or reliance on any information or material on the Site, whether or not advised of the possibility of such damages or losses and regardless of the theory of liability. 
  • Third-party websites:  We may from time to time provide links to third-party websites.  GNL has no responsibility for these third-party websites, which are governed by the Terms of Use and privacy policies, if any, of the applicable third-party content providers. If you decide to access any third party websites and make use of the information contained on them, and/or enter into any contract for the supply of goods or services from such third party, and/or make any donations to such third party, you do so entirely at your own risk. GNL accepts no liability for any damage or loss, however caused, in connection with the use of or reliance on any information, material, products or services contained on or accessed through any such linked website.
  • Force Majeure and Internet Frailties: Other than for payment obligations by Subscriber, neither party will be liable for a delay or failure to perform an obligation to the extent that the delay or failure is caused by an occurrence beyond the party’s reasonable control. Each party acknowledges that the operation of the Internet is beyond the other party’s reasonable control, and neither party will be liable for a delay or failure caused by an interruption or failure of telecommunication or digital transmission links, Internet slow-downs or failures, bugs, or other such transmission failure.
  • Governing law/Jurisdiction:  Your use of this website and any dispute arising out of such use of the website is subject to the laws of the Federal Republic of Nigeria without regard to its conflict of laws principles.

GNL reserves the right to change the Terms of Use under which this website is offered at any time and without notice. You will be automatically bound by these modifications when you use this site, and should periodically read these Terms.

PRIVACY POLICY OVERVIEW

In order to inform you of its policies and activities with respect to the collection, use and transfer of personal data on its website(s), GNL(“Guardian Studios”, “our”, “us” or “we”) is providing you with this privacy policy (“Privacy Policy”) which explains how GNL and its affiliates uses and protects personal information that you provide when you use this website, our mobile applications, downloadable applications, and other services that link to this policy. We provide this notice explaining our online information practices and the choices you can make about the way your information is collected and used.

This Privacy Policy is effective as of August 2018 and in order to check updates to this Privacy Policy, please consult this page on a regular basis (see ‘Consent; Changes To Privacy Policy’ below for more information).

INFORMATION WE COLLECT

GNL collects personally identifiable information which is specifically and voluntarily provided by visitors to the Site (Information you provide to us), information collected by cookies or third-party analytics tools with personal information maintained by GNL (Information we collect automatically). 

Information You Provide to Us

  • Contact and registration information: such as your name, address, telephone number, email address, Company, Job Title, username, and password.
  • Information about you or your friends and family: We may collect Information you submit about other people. For example, you might submit Information to invite a friend to participate in an offering, make recommendations, or share content. By processing these requests, we may receive the other person’s Information such as demographic or biographical information, gender, interests, photos, videos, or any other information about you that you provide to us, including information about friends, contacts or referrals.
  • Transaction information: payment information such as your credit/debit card details, purchase history, delivery address and other information related to your transaction.
  • Survey information: We may carry out surveys and panel discussions, which may request that you voluntarily provide additional information.
  • Customer care, technical support and other feedback: questions and other messages you address to us directly through online forms and social media platforms. If you contact us by phone, we may record the conversation and/or keep a summary of the call.
  • Other information you provide: any other information that you provide to us including, posts, date of birth, content, photos, booking times or biometric identifiers such as facial scans or fingerprints.

Information We Collect Automatically

  • Device Information: including your IP address, browser types, browser language, operating system, platform type, device types, and device IDs such as unique identifiers, or advertising identifiers.
  • Usage Information: including files you download, domain names, landing pages, your browsing activity, what you click, scrolling and keystroke activity, pages viewed, advertising viewed or visited, forms or fields you complete or partially complete, search terms, whether you open an email and your interaction with the content, access times, and error logs, and other similar information.
  • Location Information: including the city, state and ZIP code associated with your IP address, information derived through WiFi triangulation, and precise location information from GPS-based functionality on your mobile devices or from your use of our Mobile Apps, and with your consent, your precise GPS information.
  • Viewing Behavior: including the content you view, how long you watch each video, the quality of the service you receive (e.g. buffering, load times) as well as advertisements you have been shown or interacted with.
  • Offline Information:  Certain information may also be stored while you are offline and transmitted to us when you next connect to the Internet, regardless of where you connect from or the device you use to connect.
  • Social Media Information: if you visit Our website on a device on which you also use social networks or if you interact with us through a social media service or other platform, we may have access to some information you provide to that social network or platform such as your name, email address, friend list, photo, age, gender, location, birthday, social networking ID, current city, and the people/sites you follow, the posts or the ‘likes’ you make.

 

Guardian Newspapers Limited’s intention is not to seek or collect “Sensitive Personal Data” through the Site. “Sensitive Personal Data” means personal data concerning racial or ethnic origin, political opinions, religious or philosophical beliefs, trade-union membership, or concerning physical or mental health, sex life or criminal record.  If a visitor believes the Site has collected excessive information, we encourage the visitor to contact us at contact@guardian.ng to raise any concerns.

 

HOW WE USE INFORMATION COLLECTED

When a visitor provides personal information to us, we use it for the purposes for which it was provided to us as stated at the point of collection (or as obvious from the context of collection).  Examples of the types of use are given in the ‘Information We Collect’ section above.  

GNL will not sell, distribute or lease your personal information to third parties unless we have your express written permission or are required by law to do so. We may use your personal information to contact you about Guardian Newspapers Limited’s business, services and events or to send you promotional information about Guardian Studios. You may opt-out of the above at any time by sending us an email at contact@guardian.ng.  GNL may also use you information in order to administer and manage the Site or communicate with you about the Site. Your personal information will never be shared with third parties for those third parties’ direct marketing use.

Protecting Your Information

GNL is committed to ensuring that your information is secure. To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online. However, you should be aware that, due to the open and unsecured character of the Internet, GNL cannot be responsible for the security of transmissions of your personal data over the Internet.

GNL may disclose your personal data in order to:(i) enforce our website Terms of Use,(ii) in urgent circumstances to protect personal safety, the public or Guardian Studios’ website, (iii) for regulatory compliance purposes, or (iv) as otherwise set out in this Privacy Policy. It is also possible that we may be required by law to disclose your personal data pursuant to applicable law, statute, rule, regulation or professional standard, or through judicial or other government subpoenas, warrants, or orders, potentially, in any country where we do business.

How We Use Cookies

Cookies are small pieces of data that a website sends to your computer’s web browser while you are navigating through it. Once you agree to a cookie, the data is added and the cookie helps analyze web traffic or lets you know when you visit a particular site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.

We use traffic log cookies to identify which pages are being used. This helps us analyze data about web page traffic and improve our website in order to tailor it to visitor/customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system.

Overall, cookies help us provide you with a better website, by enabling us to monitor which pages you find useful and which you do not. A cookie in no way gives us access to your computer or any personally identifiable information about you, other than the data you choose to share with us.

Third Parties

GNL operates internationally, and many of our computer systems are currently based in Nigeria, this means Information we collect will be processed by us in Nigeria where data protection and privacy regulations may not offer the same level of protection as in other parts of the world. Personal data collected by GNL may be transferred or disclosed to third party contractors, subcontractors, subsidiaries and/or other GNL service providers for the purposes for which the visitor has submitted the information and for the administration of our system or site and/or other internal, administrative purposes.  Personal data may also be transferred to third party service providers of identity management, website hosting and management, data analysis, data backup, security and storage services.  As a result, personal data may be transferred outside the country where the visitor is located.  By submitting data on Guardian Newspapers Limited’s website, the visitor is providing explicit consent to the transfer of such data for the fulfillment of his or her voluntary requests or otherwise as set out in the ‘How We Use Information Collected’ section. If you use or visit our Sites from outside Nigeria, you consent to the collection and/or processing in Nigeria of Information we collect from you.

Third-Party Links

Guardian.ng may link to other websites which do not operate under Guardian’s privacy practices.  When you link to other websites, Guardian’s privacy practices no longer apply.  We encourage visitors to review each site’s privacy policy before disclosing any personally identifiable information.

Data Retention

The personal data you submit to GNL will only be retained for as long as is required for the purposes for which it was collected.  Contact information about visitors such as mailing list information is kept until a user chooses to opt-out of a certain communication or requests that we delete that information.

Opt-Out

Should visitors later choose to opt-out from mailing lists or any registrations, visitors may do so by emailing the email address provided at the bottom of the applicable email or by contacting us at contact@guardian.ng

YOUR RIGHTS

Where granted by local law, you may have the right to request access to the personal data that we have collected about you for the purposes of reviewing, modifying or requesting deletion of the data.  You may also have the right to request a copy of the personal data that we have collected about you.  In certain circumstances, you may also request that we cease processing your personal data. 

If you would like to make a request to access, review or correct the personal data we have collected about you, please contact us at contact@guardian.ng.  GNL is committed to providing reasonable and practical access to visitors to allow them the opportunity to identify and correct any inaccuracies.  When requested and practical, GNL will delete identifying information from current operational systems.  GNL does not assume responsibility for verifying the ongoing accuracy of the content of personal information.

Your California Privacy Rights – If you are a California resident, you may request and obtain from us once a calendar year, information about our practices related to your personal information we shared, if any, to certain third parties during the preceding year, for their own direct marketing use. If applicable, this information would include the categories of your information and the names and addresses of those third parties/businesses with which we shared your information for the immediately prior calendar year (e.g., requests made in 2018 will receive information regarding 2017 sharing activities).

You may also opt-out of our sharing of your personal information with unaffiliated third parties for the third parties’ direct marketing purposes. Note that we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.

 CHILDREN

GNL understands the importance of protecting children’s privacy, especially in an online environment.  This website is not designed for or directed at children 13 years of age or younger, and GNL does not intentionally collect or maintain personal data about anyone 13 years of age or younger. If you are a parent or guardian and you learn that your Child/Children have provided us with Personal Information, please contact us at contact@guardian.ng. If we become aware that we have collected Personal Information from a Child under age 13 without verification of parental consent, we take steps to remove that information from our servers.

CONSENT; CHANGES TO PRIVACY POLICY

By using the Sites, you consent to the collection, use, and storage of your personal data by us in the manner described in this Privacy Policy and elsewhere on the Sites. We reserve the right to make changes to this Privacy Policy from time to time. We will alert you to any such changes by updating this Privacy Policy. If we make material changes to this Privacy Policy that increase our rights to use personal data that we have previously collected about you, we will obtain your consent either through an email to your registered email address or by prominently posting information about the changes on our Sites. The date at the top of the Privacy Policy tells you when it was last updated. Any changes to this Privacy Policy will become effective when the revised Privacy Policy is posted.
