THE Tax Appeal Tribunal, Abuja, has adjourned hearing till Feb.3 in the suit filed by Milan Nigeria Ltd., seeking refund of N28.15 million from the Federal Inland Revenue Service (FIRS).

The tribunal’s Acting Chairman, Mr Nnamdi Ibegbu, adjourned the matter at the instance of Milan Nigeria Ltd.

Mrs Ifedayo Owoso, legal adviser to Milan had told the tribunal that their counsel informed her that he would not be at the tribunal.

Mr Bright Igbinosa, counsel to FIRS, also informed the tribunal that the witness that ought to be cross-examined was not at the tribunal due to the prior information given to him by counsel to Milan.

The News Agency of Nigeria (NAN) reports that Milan in its claims, sought refund of N28.15 million Value Added Tax (VAT) deductions from FIRS.

In the appeal dated May 17, 2012, were also several claims by both parties, one of which stated that Milan Nigeria Limited owed FIRS N23. 17million.

Milan then appealed that FIRS should deduct the above sum from the VAT refund of N28.15 million.

In the same appeal, Milan requested that the deducted amount of N4. 95 million should be used to settle future tax liabilities.

Milan also appealed that the interest and claims of N53 million against the company should be waved-off. (NAN)
