Court grants bail to man arrested for reporting Immigration officer for allegedly raping wife

A High Court in Bauchi State has ruled that Samaila Yusuf who was arrested and charged for kidnapping after reporting an operative of the Nigeria Immigration Service, Sani Mua’zu for allegedly raping his wife, be granted bail.

Yusuf was incarcerated for 11 days after reporting to the Bauchi Police that he allegedly caught Mua’zu raping his wife in the presence of his two children.

Meanwhile, Police had said that it received a petition against the complainant over an offense of kidnapping.

But the presiding Judge, Justice L. Umar granted bail to Yusuf on Tuesday, under Order XV Rule 4 of the Fundamental Human Right (Enforcement Procedures) Rules 2009 of Section 45 of the 1999 Constitution.


The Country Director of the Human rights organisation, Mohammed Alkassim, said that a human rights group had approached the court for justice to enforce the section of the Constitution against the violation of the rights of Yusuf in suit number: BA/82M/2024.

Alkassim applauded the court for granting bail to Yusuf who regained freedom while calling on human rights groups to come to the aid of the wife by prevailing on the police to carry out proper investigation of the allegation of rape.

The Presiding Judge has fixed February 29, 2024, as the return date for the hearing of the motion on notice.
