Court fixes Nov. 10 for hearing breach of contract suit against firm

Justice Sunmonu Tunde Bashiru of the Lagos State High Court has fixed November 10, 2025, for hearing in a suit filed against DNJ Properties and Investment Limited over an alleged breach of contract.

The claimant, Mr Olufemi Enahoro Odiri, through his counsel, Ademola Adefolaju, sued the real estate firm for allegedly failing to deliver a two-bedroom apartment he fully paid for, despite repeated demands.

The suit marked LD/ADR/5956/2025, seeks various reliefs, including a court declaration compelling the firm to allocate the said apartment located at Plot 14 and 16, Eru Ifa Street, Ikate, Lekki, Lagos.

At the proceedings, the claimant’s counsel informed the court that the defendant had been served with all processes in the matter but had failed to respond.

Justice Bashiru consequently adjourned the matter to November 10 for hearing and directed that a hearing notice be issued to the defendant.

In his statement of claim, Odiri alleged that the company entered into a joint venture agreement with the original landowner, Mr Michael Adekunle Oniyitan, for the development of residential apartments on the property.

Under the agreement, DNJ Properties was to construct 13 units of two-bedroom apartments, two units of three-bedroom apartments with boys’ quarters, and two maisonettes.

Odiri claimed he was introduced to the project in 2023 by representatives of the firm, who assured him that all necessary approvals had been obtained and that construction would be completed within 18 months.

Relying on these assurances, he said he subscribed to a unit of the two-bedroom apartment for N50 million and paid the amount in full into the company’s First City Monument Bank account.

However, he alleged that upon visiting the project site in March 2025, he discovered that construction had not begun and that the defendant had instead put the entire property up for sale.

He claimed that the defendant diverted his funds and attempted to dispose of the land without his knowledge.

The claimant is asking the court to order the defendant to either allocate the apartment or pay him N200 million, which he said represents the current market value of the property.

He is also seeking N5 million as the cost of litigation, as well as pre-judgment interest at 21 per cent yearly and post-judgment interest at 19 per cent until full payment.

Odiri further claimed he has suffered emotional and psychological distress due to the defendant’s action.
