Kano Emirates Law: Assembly leaves proceedings for A’Court

• Kano politics will mar Tinubu’s govt, Galadima warns

Kano State House of Assembly has asked the Court of Appeal, Kano, to stay further proceedings on a motion filed by Aminu Danagundi, the Sarkin Dawaki Babba, at the Federal High Court (FHC), Kano, challenging the legality of the Kano Emirates Council (Repeal) Law 2024, pending the hearing of their appeal.

 
But a chieftain of the New Nigeria Peoples Party (NNPP), Buba Galadima, asked the Federal Government to stay away from Kano politics, warning that it would destroy President Bola Tinubu’s government.
 
Meanwhile, the presidential candidate of NNPP in the 2023 election, Rabiu Kwankwaso, has accused the Federal Government of compromising security in Kano and listening to enemies of the state.
  
Justice Muhammad Liman of Kano FHC had suspended the operation of the repealed law through an ex parte injunction filed by Danagundi. The court subsequently scheduled ruling on the legality of the repealed law for Thursday, June 20, 2024.
  
Dissatisfied with the injunction, Kano Assembly and its Speaker lodged an appeal marked CA/KN/26/2024 through their counsel, Eyitayo Fatogun (SAN), against Danagundi and six others for an order of injunction restraining the respondents or authority deriving power from them from enforcing the repealed Emirate Council law, pending the hearing and determination of the appeal.
  
The appellants also prayed the court to stay execution on all orders, particularly the ex parte order granted on May 23, 2024, by the lower court, pending the hearing and determination of the appeal. 
 
 Other respondents in the appeal are the Kano government, the Attorney General, the Commissioner of Police, the Inspector-General of Police (IGP), the Nigeria Security and Civil Defence Corps, and the Department of State Services (DSS).
  
In its motion on notice brought under Sections 6 and 36 of the 1999 Constitution, Order 7 Rule 1 of the Court of Appeal Rules and under the inherent jurisdiction of the court, the appellant prayed the court to take over the entire proceedings due to conflicting orders of the High Court and FHC on the same matter.
  
In its application for an urgent date, the appellant stated that the Federal High Court Kano on or about June 13, 2024, delivered its ruling in a suit filed for the Enforcement of the Fundamental Rights of a kingmaker as it relates to the Kano State Emirate Council (repeal) Law 2024 made by the House of Assembly and signed by the governor.
  
The appellants said they filed a stay of proceedings before the lower court, following their appeal against its order, but regretted that the court refused the application. 

IN an interview with Arise Television, yesterday, Galadima said Tinubu should be mindful of his intervention in the state’s politics because it will “destroy his presidency”.

 
Galadima said if Boko Haram could hold Nigeria to ransom in the last 13 to 14 years, Tinubu would not be able to withstand the issue that would come from Kano, if he interfered in the state’s politics.
 
“I want to tell the Federal Government, including my friend, Tinubu, that he should be mindful of Kano politics, it will destroy his presidency,” he said.

KWANKWASO, during the flag-off for the construction of 82 kilometres of rural road networks in Madobi, his hometown, said the Federal Government was listening to some “unpatriotic politicians” from the state.
 
The former Minister of Defence was reacting to the situation in Kano, in which security agencies were accused of backing Aminu Ado Bayero, the deposed emir.
 
He said the people of Kano would resist any attempt to undermine constituted authority in the state. Kwankwaso said, “We have mass followership because people believe in us; we are pro-people and the NNPP administration is determined to serve them anywhere they vote for it.
 
“We will not fold our arms and watch enemies of the state destroy the peaceful co-existence in our dear state, as we shall do everything possible to support the governor to succeed. I am happy he is not distracted but focused on achieving his goals.”
