Appeal Court affirms Igbuya’s election

THE Court of Appeal sitting in Benin City, Edo State yesterday upheld the ruling of the Election Petitions Tribunal, Asaba which declared the Speaker of the Delta State House of Assembly, Rt. Hon. Monday Igbuya winner of the April 2015 House of Assembly election for Sapele constituency. The court also awarded cost of N100,000 against the petitioners.

Hon. Monday Igbuya winner of the April 2015 House of Assembly election for Sapele constituency. The court also awarded cost of N100,000 against the petitioners.

The appellant court said the petitioners failed to prove substantial non-compliance to the Electoral Act.

“The petitioners also failed to prove acts of irregularity and as such, the appeal must fail,” it ruled.

In a statement yesterday in Asaba, Igbuya described his victory as triumph for the common man and democracy.

He noted that the feat was significant for the development of the state, particularly his constituency.

The Speaker not only praised the judiciary for dismissing Felix Anirah’s case but also said his election was a well-deserved mandate.
He thanked the people of Sapele for the confidence reposed on him.
