Raheem’s death: Court fixes April 3 to rule on suspended police no-case submission

Justice Ibironke Harrison of a Lagos High Court sitting at the Tafawa Balewa Square (TBS), yesterday,  fixed April 3, 2023, for ruling on the ‘no-case submission’ filed by Assistant Superintendent of Police (ASP), Drambi Vandi, who is on trial for killing a Lagos-based lawyer, Omobolanle Raheem, on Christmas day.
 
The trial judge fixed the date for ruling, after counsel to parties adopted their final written addresses in the no-case submission file by Vandi.
 
The counsel to the defendant, Mr. Adetokunbo Odutola, who adopted his final written address,  on a no-case submission, filed on February 28, 2023, urged the court to dismiss the suit and discharge the defendant, claiming that he has no case to answer.
 
Vandi’s counsel also argued that the ballistic report revealed that the gun did not match the bullet that was shot.
 
Odutola told the court that the pathologist who testified mentioned that the bullet penetrated from the left through the armpit, while the prosecution stated that the deceased was shot in the chest.
   
He further told the court that the prosecution does not have a case against the defendant.
   
The defendant contended that the prosecution has not made out a prima facie case against the defendant to warrant him enter defence
   
In his response, the prosecution team lead by Attorney General of Lagos State, Mr. Moyosore Onigbanjo (SAN) told the court that the state has equally filed a response to the defendant’s application.
 
He urged the court to order the defendant to come up to defend himself in the case.
   
Onigbanjo submitted that the state had instituted a one-count charge of murder contrary to Section 223 of the Criminal Law of Lagos State, 2015, against the defendant and arraigned him for the lawyer’s death.
 
After listening to their arguments, the judge subsequently adjourned ruling on the matter  to April 3,2023.
