Justice O.O Ogunjobi of a Lagos High Court has restrained the Lagos State Government and others from installing the new Olu of Iwaya, pending the determination of a suit filed by Ramon Rufai Ogo-Oluwa Aromire and others.
The judge granted the injunction to stop Ogun-Oloko from receiving the staff of office till the determination of the suit marked no LD/7218GCMW/2020.
The court also ordered one Sulaiman Ogun-Oloko to stop parading himself as Olu of Iwaya Kingdom or acting in the office of the Olu of Iwaya Kingdom while ruling on a motion exparte brought before the court.
The claimants – Ramon Rufai Ogo-Oluwa Aromire, the Olu of Iwaya-elect by Oloto Royal Family Ruling House of Iwaya Kingdom, Adelani Onitolo, Oluwole Onitolo and Rufai Kolawole Babatunde had instituted the suit against the Lagos State Governor, Babajide Sanwo-Olu, the state Attorney General and Commissioner for Justice, Commissioner for Local Government and Community Affairs, the chairmen of Lagos Mainland and Yaba Local Council Development Area and Sulaimon Ogun-Oloko as respondents respectively.
Ruling on the motion exparte, the vacation Justice Ogunjobi granted leave to the applicant, (Ramon Rufai Ogo-Oluwa Aromire) to apply, by way of judicial review, for declaration of the court setting aside the purported installation and or recognition of one Sulaiman Ogun-Oloko as the Olu of Iwaya Kingdom.
Sulaiman Ogun-Oloko, who has been parading himself as Olu of Iwaya is expected to receive the staff of Office from the state government.
The Obaship tussle has been pending in Lagos High Court for the past two years before Justice Ogunjobi granted the injunction to stop Ogun-Oloko from receiving the staff of office.
The judge, however, set aside the purported installation and recognition of Sulaimon Ogun-Oloko by the Lagos State government whether on May 25, 2023 or May 27, 2023 as the Olu of Iwaya Kingdom, during the pendency of the suit, or risk being in contempt of the court.
The court therefore granted, “An order of Mandamus, mandating the 1st, 2nd, 3rd, 4th and the 5th defendants/respondents to ensure that the stool of Iwaya Kingdom being the res in Suit No: LD/7218GCMW/2020; between Mohammed Bashiru Akinola & 90rs v. The Governor of Lagos State & 160rs, be restored to its status quo preceding 25/05/2023 and to remain, pending the determination of suit.
“An order of Injunction restraining the 6th defendant/respondent from parading himself as the Olu of Iwaya Kingdom or acting in the office of the Olu of Iwaya Kingdom pending the determination of suit Akinola & 9 Ors v. The Governor of Lagos State & 16 ors.” He subsequently fixed September 19, 2023 for hearing of the case.
