NDLEA turns down Kashamu’s request to vacate his residence

NDLEA turned down an order requesting it to vacate the residence of Senator-elect, Buruji Kashamu, in Lagos.

buruji-kashamu-3The National Drug Law Enforcement Agency (NDLEA) on Tuesday turned down an order requesting it to vacate the residence of Senator-elect, Buruji Kashamu, in Lagos.

The Agency’s Head of Public Affairs, Mitchel Ofoyeju, disclosed this in a statement in Lagos .

Ofoyeju said that the agency received a court order to vacate the residence and directed both Attorney General of the Federation, Mr Bello Adoke and Ahmed Giade, Chairman, NDLEA to appear in court.

According to the statement, the NDLEA did not believe that any court would issue such warrant preventing any agency to perform its statutory role as drug trafficking law enforcement agency.

Ofoyeju said the agency would continue to maintain its stand on monitoring the residence of the Senator-elect in preparation for his extradition after his appearance in court.

“The NDLEA wishes to reiterate that his rights like that of other citizens shall be respected and the due process of law followed in this case.

“The agency is prepared to further increase its public rating and goodwill in the areas of suspect handling.

“Respect for human rights and the rule of law.

“We are prepared to explore all legal means in handling this case to a logical conclusion,” the statement said.

Ofoyeju said that the Nigerian Government had received request from the United States Government for the extradition of Prince Buriji Kashamu.

He said that the U.S government had also provided Warrant of arrest on him contrary to what his attorneys said that there was no warrant of arrest to effect their actions.

“According to official record, Kashamu has been a target of both the U.S. Drug Enforcement Administration (DEA) and Immigration.

” In addition with Customs Enforcement (ICE) of the Department of Homeland Security (DHS) for over 20 years.

“He was further indicted by the Grand Jury in the Northern District of Illinois, United States on heroin trafficking charges, ‘’ the statement said.(

    The senator elect, should obtain a certified copy of the British court’s order denying the extradition request and with it, file a motion to quash the extradition request in Nigeria under res judicata and collateral estoppel doctrine, that should in my opinion operate as a total bar to the extradition request. Second, why is the NDLEA, the agency to prosecute an extradition request? It’s primary function is to interdite illegal drugs circulation and not to usurp the functions of the Attorney General and the police. The NDLEA doesn’t have jurisdiction over an alleged offense that occurred overseas.

    Nigeria is the only country that is ever eager to hand over its citizens to foreign countries for prosecution. I see Obasanjo’s hand in this affair. How many American citizens have ever been extradited to Nigeria for trial? How many British citizens have ever been extradited to Nigeria for Prosecution? Answer, none!
    when did Nigeria sign the extradition treaty with America? I will submit that Nigeria has no formal extradition treaty with the USA.
    If Israel and Mexico that enjoys a closer relationship with America do not extradite their citizens to the USA, why Nigeria! Israel never extradites its citizens to any country as a matter of law and fact. Mexico may, but it’s a case by case basis. If the U.S.A offense calls for the death penalty or unnecessary harsh punishment, Mexico does not extradite, unless the U.S.A authorities agree not to seek the death penalty or, agree to a modified sentence. That’s why when Mexicans commit crimes in USA. They run to Mexico in order for the Mexican authorities to help. Nigeria is the only country that ceded its teritory (Bakassi) on account of a so-called International Court order in violation of its constitution and in violation of its citizens rights to universal suffrage. No wonder Nigeria is rediculed all over the world.

    Opinions like those expressed here are the reason why ‘big’ men in Nigeria act with impunity – there will always be educated people who will intellectualize corruption on the basis of some supposed ‘civil rights’ infraction. So, we are now expressing some fake nationalism when it is obvious that our entire judicial system is riddled with corrupt judges and law enforcement officials. So, in the same vein, you all see nothing wrong with Alamesiegha who escaped the justice in the UK only to be released and honored in Nigeria- because the Nigerian courts and political system allowed this? Sorry, the rights of any Nigerian is trumped by the right to life of all those who died as a result of his alleged drug trafficking. The alleged crimes were committed on American soil, and they also have the right to request extradition. Let us rise up against a national pastime that is permissive of corruption by shielding accused criminals from facing those they have perpetrated crimes against. Justice is not the same as ‘the law’. The latter is there to support the former and not the other way round.

    Someone somewhere is instigating all of the there just to disgrace this man. For NDLEA, if court says leave Kashamu’s house, why would they be lawless? Which means, there is somebody out there giving them the impunity and audacity to do what they are doing, which is harassment, intimidation and manipulation on Kashamu no matter what he has done, things should be done in the proper way. I love to read the comments from other people in this forum.

    everyone thatmade comments on this issue made valid points one way or another but what they seems to overlook is that all the places they mentioned do not have corruption entrenched in their constitution if you what I mean.
