7 docked over alleged trespass

criminal-trespassA 57-year-old Lagos-based land surveyor, Fajemirokun Ade, and six others who unlawfully entered a plot of land , were on Wednesday docked at an Igbosere Magistrates’ Court in Lagos by the Police.

The other accused are : Lateef Adesina, 29; Segun Shobayo, 34; Oluwaseyi Adeboye, 27; Taofeek Dada, 28; Olyede Oladririn, 29; and Kabiru Oladosu, 39.

The accused, who reside in FESTAC Town, Lagos State, are standing trial on a three-count charge of conspiracy, breach of the peace and trespassing.

The Prosecutor, Insp. Philip Osijale, told the court that the accused committed the offences on April 7, at 2 p.m., at 6th Avenue, FESTAC Town.

Osijale said that the accused conspired and entered into a lot of land which was in lawful possession of one Mr Deji Oloko.

He said that the accused allegedly conducted themselves in a manner likely to cause a breach of public peace.

The prosecutor said that the offences contravened Sections 52, 186 and 409 of the Criminal Law of Lagos State, 2011.

The accused pleaded not guilty to the charge.

The News Agency of Nigeria (NAN) reports that Section 52 provides that any person who conducts himself in a manner likely to cause a breach of the peace, enters a land which is in the actual possession of another, is guilty of an offence and liable to two years’ imprisonment.

The magistrate, Mrs A. F. Botoku, granted the accused bail in the sum of N250, 000 each, with one surety each, in like sum.

She said that the sureties must be gainfully employed and provide evidence of three years’ tax payment to the Lagos State Government.

Botoku also ordered that the court prosecutor must verify the addresses of the sureties.

She adjourned the case to April 29, for mention.
