An Oyo State High Court sitting in Ibadan has struck out the murder case against the founder, Agidigbo 88.7FM, Ibadan, Alhaji Oriyomi Hamzat, and four others accused of murder of a teenager.
The case was first heard at an Iyaganku Magistrates’ Court on August 1, 2017.
It was, however, transferred to the High Court, as the Magistrates’ court had no jurisdiction to hear the case, and eventually, ended up with six magistrates and judges sitting over the case.
The trial judge, Ladiran Akintola, held that the applicant – which is the state government had recently filed to discontinue the suit, and called no witness or presented any evidence throughout the trial.
Justice Akintola freed Alhaji Oriyomi and four others of the charges against them.
Alhaji Hamzat, Idowu Ibrahim, Mohammed Bashir, Taiwo Olaronke and Yusuf Ajisafe were all arraigned on a two-count charge of conspiracy and murder.
The prosecutor, Sunday Fatola, had told the court that the defendants conspired among themselves to commit murder.
Fatola alleged that the defendants unlawfully caused the death of one 17-year old Peter, by inflicting an injury on his head and body.
The prosecutor said Peter, who had been an inmate at a home owned by the Make a Future Alive Initiative, a non-governmental organisation owned by Hamzat, was found dead, on July 21, 2017 at about 4.00 a.m. at his home in the Oremeji Agugu area of Ibadan.
