A High Court sitting in Ilorin, Kwara State, has issued an order of interim injunction against a traditional ruler in Edu Local Council, the Etsu of Tsaragi, Aliyu Kpotwa, from removing or dealing in any manner with the head of Ndadzoko, in Tsaragi Emirate, Attahiru Abdulkadir.
The court, presided over by Justice I. A. Yusuf, also ordered that parties in the suit KWS/455/2023 should maintain status quo pending the hearing and determination of the motion on notice.
The claimant, Abdulkadir, who is also chairman of Kingmakers of the emirate, was appointed and turbaned in 2016.
Also, the order also restrained the emir from dealing with the lands belonging to the claimant’, pending the hearing and determination of the motion on notice.
Part of the order of interim injunction reads: “Restrain the 1st defendant from appointing or turbanning the 2nd defendant (Tetengi Ndadzoko) or anybody whosoever as a parallel or new Ndadzoko of Tsaragi pending the hearing and determination of the motion or notice.
“Restrain the 2nd defendant from parading as head of Ndadzoko family, pending the determination of the motion on notice.”
Counsel to the claimant, I.B. Ayegbami, moved for motion ex parte, while the court, having considered the application moved, went ahead to grant the same.
Justice Yusuf later adjourned the case till December 12, 2023 for hearing of the motion on notice.
