A Federal High Court in Abuja has fixed Tuesday , February 2, 2016 for ruling on whether or not to grant bail to the alleged masterminds of Abuja 2010 Independence bombings Charles Okah and Obi Nwabueze bail.
Justice Gabriel Kolawole, gave the date after both counsel to defense and counsel to the prosecution argued the applications for and against the bail.
Counsel to Okah, Samuel Zibiri, (SAN), told the court that he brought application for bail pursuant to Section 158, 161 sub-section (2 a,b,c) of the Administration of Criminal Justice (ACJ) Act 2015.
The defense counsel said the application was in line with the provision of Section 35 (5) of the 1999 constitution as amended.
Zibiri recalled that the application seeks for an order to admit the defendant to bail pending the determination of the case.
He said: “In the application, my lord we raised one sole issue for determination, whether the defendant can be admitted to bail on the grounds of ill health.”
