
A Surulere Chief Magistrates’ Court on Friday in Lagos struck out the case against eight security men who were charged with vandalizing a car for lack of evidence.
Chief Magistrate M.I. Dan-Oni ruled that there was not enough evidence from the police against the accused to prove the allegations brought by it.
“Besides, the name of the complainant and the address where the alleged offences were committed were not indicated on the charge sheet.
“It is wrong to read out an allegation that is not indicated on the charge sheet,’’ the chief magistrate said.
The accused were: Richard Daloeng, 20; Emmanuel Bawa, 26; Godday Yakubu, 23; Muhammed Bashir, 43; Kaita Amodu, 18; Abubarka Amodu, 21; Adams Umar, 20; and Victor Ogiale, 25.
They had earlier during their appearances pleaded not guilty to the charges preferred against them.
They were docked on a two-count charge of vandalism and breach of the peace.
The prosecutor, Insp. Gabriel Ekundayo, had at the previous sittings told the court that during that the accused committed the offences along Eric Manuel Crescent, off Bode Thomas Street in Surulere, Lagos State.
Ekundayo said that the accused had committed the offences between Jan. 15 and Jan. 16 where the complainant, Mrs Fadekemi Agarawu, parked her car.
He said the accused, who were security men on the street where the vandalism was done, were aware that Agarawu parked her Toyota Matrix car with Registration Number: LND 144 DV within the crescent.
“The accused refused to prevent the car from being vandalised,’’ the prosecutor said.
The prosecutor also said that the accused conducted themselves in a manner that caused a breach of the peace on the crescent where the offences were committed.
Ekundayo said that the offences contravened Section 408 and 166 (D) of the Criminal Laws of Lagos State, 2011.
