Court orders MLSCN, Health Minister to retain Emeribe as Registrar




The National Industrial Court of Nigeria (NICN) Abuja has ordered the Defendants/Respondents, the Minister of Health and the Medical Laboratory Science Council (MLSCN), not to remove the Claimant/Applicant, the Registrar/Chief Executive Officer (CEO) of MLSCN, Prof. Anthony O. Emeribe, from office.

The enrolled order in suit number: NICN/ABJ/62/2016 dated March 2, 2016, sought in the motion ex parte on behalf of the claimant/applicant the following orders:- An Order of Interim injunction directing the defendants by themselves, officers, agents, privies; and any other person whatsoever from interfering with the claimant’s appointment by the 2nd defendant’s Registrar/ Chief Executive Officer of the 2nd defendant pending the hearing and determination of the claimant’s Motion on Notice for Interlocutory Injunction in this suit.

“An Order enjoining the parties to maintain the status quo ante bellum; that is to say the status quo prior to 19th February, 2016.

And For Further Orders as this Honourable Court may deem fit to make in the circumstances of this case.”
In his ruling Hon. Justice P.O Lifu said“… Consequently, in the interest of justice, the court hereby Orders as follows:- The defendants/respondents in this case are herein restrained by themselves, agents, privies or any person acting on their behalf or on their instruction from interfering with the claimant/applicant’s employment, status, position and privileges as the Registrar, Chief Executive Officer of the 2nd defendant or in any way filling the said position pending the hearing and determination of the Motion and Notice dated the 23rd of February but filed on the 24th of February 2016.

The return date in this case shall be the 9th of March 2016.“Meanwhile the claimant/applicant is to enter into written undertaken to pay N100,000.00 damages to the defendants if it is found at the end of the day that this Interim Order was unnecessary or the court was misled.

“In obedience to the directive of the Honourable President of this court, this suit is hereby transferred to his Lordship for further action or re-assignment.
