Mbabou of Agedam Community in the Gboko West Local Government Area was arraigned before Magistrate Mrs Lillian Tsumba for allegedly killing one Luke Anyanwu during a fight.

Mbabou was charged with culpable homicide punishable under Section 225 of the Penal Code Laws of Benue State, 2004.

The Police Prosecutor, Insp. Terzungwe Kajo, told the court that the case was transferred from ‘A’ Division Police Headquarters, Gboko to the Criminal Investigation and Intelligence Department, Makurdi for investigation.

He said that the accused was arrested during police investigation for allegedly committing the offence.

Quoting from the letter of transfer, he said the wife of the deceased, Mrs Theresa Anyanwu, had reported at the police station on Sept. 1 that her husband was killed.

She stated that on Aug. 29, the accused kicked her husband on the face during a fight and blood started gushing out of his mouth.

She said her husband was rushed to the General Hospital, Gboko but died while receiving treatment.

The plea of the accused was not taken for want of jurisdiction when the case came up for hearing.

Tsumba adjourned the matter to Oct. 28 and ordered the remand of the accused at the Makurdi Prisons.
