Hearing on contempt application against NRC MD for June 21

Justice Moji Olatoregun of the Federal High Court, Lagos has fixed June 21, 2017 for hearing of application filed by Benedict O. Iheakam against the Nigerian Railway Corporation and it’s Director, Engineer R.N Madueke for alleged disobedience to order of court.

Justice Moji Olatoregun of the Federal High Court, Lagos has fixed June 21, 2017 for hearing of application filed by Benedict O. Iheakam against the Nigerian Railway Corporation and it’s Director, Engineer R.N Madueke for alleged disobedience to order of court.

The judge fixed the date after the submissions of counsel in the suit when the matter was last heard. The plaintiff counsel, Mr Johnson Esezoobo told the court that he had served one of the respondents the application (form 49).

Esezoobo stated that the Managing Director was served and his lawyer was in court. He added that the company (Nigeria Railway Corporation) was yet to be served.

Mr. Opeyemi Igbayiloye, counsel to the 2nd respondent (Madueke), confirmed been served. Madueke and the Nigeria Railway Corporation was alleged to have refused to obey the order made by Justice Dan Abutu in a suit delineated FHC/L/CS/926/95 to reinstate the plaintiff, Mr Benedict O. Iheakam to his employment and pay his entitlements.

After 14 years of alleged refusal to comply with court order, the plaintiff’s counsel, Esezoobo filed an application asking the court for an order to commit them to prison.

Justice Abutu had declared in a judgment delivered on February 18, 2003 that Iheakam, a Principal Technical Officer’s purported retirement vide letter dated, November 1,1994 is contrary to the contract of employment and is therefore unlawful, null and void.
