The Action Peoples Party (APP) has withdrawn its petition contesting the victory of Bola Ahmed Tinubu of the All Progressive Congress (APC) in the February 25 presidential election.
At Monday’s court pre-hearing session, Obed Agu, APP’s lawyer, had said that instead of proceeding to the main hearing, parties can choose to settle disputes amicably.
Agu said the respondents — Tinubu and the Independent National Electoral Commission (INEC) — should concede to the claims of the petitioner considering the weight of claims levelled against them.
The court then adjourned the case to Wednesday for further pre-hearing.
At the resumed court session, Agu moved an application to withdraw the petition against the president-elect.
Abubakar Mahmoud, counsel to INEC; Wole Olanipekun, counsel to Tinubu; and Lateef Fagbemi, counsel to APC, did not oppose the application nor request for any cost.
Consequently, the petition was dismissed.
The APP is the latest Party to withdraw its petition against Tinubu after the Action Alliance (AA) withdrew its petition on Monday.
The court is now left to determine three other petitions by Atiku Abubakar, candidate of the PDP; Labour Party’s Peter Obi, and the Allied Peoples Movement (APM).
