Court to rule Feb 8 on Synagogue engineers’ application

JUSTICE Lateef Lawal-Akapo of a Lagos High Court sitting in Ikeja will on February 8, 2016 rule on the applications filed by the contractors indicted in the collapsed six-storey building belonging to the Synagogue Church of All Nations (SCOAN), Oladele Ogundele and Akinbola Fatiregun, who were alleged to have flouted court order.

The contractors, through their counsel, Chief E.L Akpofure (SAN) and Mrs. Titilola Akinlawon (SAN) told court that the Attorney General of Lagos flouted order made by Justice Ibrahim Buba of the Federal High Court, Lagos restraining the police and the Lagos AG from charging them to court as well as an order of substituting servic‎e.

Justice Buba had restrained them on their behalf from prosecuting or proceeding with the prosecution of the engineers on the basis of the Coroner’s verdict pending the determination of an appeal against the ruling of the Federal High court.

Both counsel submitted, that, “the order of Justice Buba was that the arraignment should be put on hold pending the decision of the Appeal Court.”

They argued that the order is still subsisting and noted that the State ought not to file charges against them and not even asking the court for order of substituting service before a Lagos High court.

“The manner of service by way of substitution is spell out by the law. So carrying out such service in the manner they did is a nullity. “

Responding to their submission, the Director of Public Prosecution (DPP), Mrs. Idowu Alakija, told the court that they have filed a response to their applications, dated January 22, 2016.
