Driver in court for allegedly causing death of FRSC Marshal in Osun




A 38-year-old driver, Lamidi Saka, was on Friday arraigned in  Osogbo Magistrates’ Court in Osun for allegedly causing the death of Mr Oladunjoye Ariyo, an FRSC Marshal.

Saka, whose address was not provided, is facing a five-count charge bordering on dangerous driving, driving without a valid driver’s licence and causing the death of FRSC Marshal.

The Prosecutor, Mr Estine Okolo, told the court that the accused committed the offence on Dec. 19, 2015, on the Osogbo-Ilorin road.

Okolo said the accused was asked to stop after a traffic infraction but drove dangerously to avoid arrest and in the process ran into the marshal who died on the spot.

According to him, the driver committed the offences while driving a white Toyota Dyna light truck with registration number XG 126 RSH.
The prosecutor further said that the accused was on the highway without a valid driver’s licence.

Okolo said that when the accused was apprehended, he produced an expired driver’s licence No. LRGOO46BA2 issued on Feb. 23, 2011.

He said the offences committed contravened Sections 20, 21, 23(1), (2),10 (4), (1),10 (11) and 25 (1) and (2) of the Federal Road Safety Commission Act, 2007.

The accused, however, pleaded not guilty to the five-count charge against him.

The counsel to the accused, Mr Samuel Ibiyemi, prayed the court to grant his client bail in the most liberal terms.

The Magistrate, Mr Olusola Aluko, granted the accused bail in the sum of N100,000 with two sureties in like sum.

Aluko said that the sureties must reside within the court’s jurisdiction and must provide evidence of tax payment.

The sureties, he said, should also submit two passport-size photographs with an affidavit of means to the court’s registrar.

Aluko, who said one of the sureties must be a relation of the accused while the other must have landed property in Osogbo, adjourned the case untill May 2 for hearing.
