Man, 73, arraigned for obtaining N500,000 under false pretences

The accused, who resides at No. 24, Simisola St., Ogunlana, Surulere in Lagos State, is facing a two-count charge of obtaining under false pretences and stealing.

A 73-year old agent, Balogun Asiwaju, on Friday appeared before an Ebute Meta Chief Magistrates’ Court in Lagos for obtaining N500,000 under false pretences from potential tenant.

The accused, who resides at No. 24, Simisola St., Ogunlana, Surulere in Lagos State, is facing a two-count charge of obtaining under false pretences and stealing.

The prosecutor, Cpl Cyriacus Osuji, told the court that the accused committed the offences on Dec. 31, at No. 5, Okoh Obele St., Oniwala Estate, Surulere.

He alleged that the accused obtained the N500,000 from the complainant, one Oluwakemi Ogunba, under the pretext that he was going to secure a flat for her.

Osuji said the accused converted the money to his personal use instead of getting the said accommodation for the complainant.

The prosecutor said that the offences contravened sections 285 (a) (b) and 312 of the Criminal Law of Lagos State, 2011.

The News Agency of Nigeria (NAN) reports that Section 285 (a) says that any person previously convicted of a felony under subsection (1) (a) of this section is liable to imprisonment for seven years.

Asiwaju, however, pleaded not guilty to the charges preferred against him.

The Chief Magistrate, Mrs M.O. Tanimola, granted the accused bail in the sum of N100,000 with two sureties in like sum.

Tanimola adjourned the case till May 20 for mention.
