Polls: Judge Warns APC, Accord, LP Counsels For Stalling Trial
THE Federal High Court in Asaba yesterday warned lawyers to the All Progressives Congress (APC), Labour Party (LP) and Accord Party (AP) against any delay tactics in a suit challenging the eligibility of the all their candidates for next Saturday’s elections in Delta state.
Justice Olatoregun Ishola adjourned the case till April 27 due to the failure of the counsels to file all the necessary documents such as affidavits, counter affidavits, objections, before the commencement of the matter as required by new practice directive.
A visibly angry Ishola lashed out at the counsels to all the parties, accusing them of not being ready for the commencement of the matter.
Ishola who ordered for accelerated hearing in the matter urged all parties in the cases to ensure that all documents reach the court within two days.
She also ordered Peoples Democratic Party (PDP) lead counsel, Mr. Akinlolu T. Kehinde (SAN) to ensure that all the parties in the case are served all the necessary papers before the next hearing date.
In his submission, Kehinde assured the court of his preparedness to ensure that the cases proceed as scheduled, but lamented: “The defence counsels were laying land mines to frustrate the matter,” adding that all the necessary papers would be made available to the defence lawyers before the next adjourned date.
In three separate suits, the PDP is seeking the disqualification of all the candidates of the three political parties standing for election in the state on the grounds that the parties violated Sections 85 (1) of the Electoral Act, 2010 as amended.
The section provides that: “Every registered political party shall give the commission at least 21 days’ notice of any convention, congress, conference or meeting convened for the purpose of electing members of its executive committees, other governing bodies or nominating candidates for any of the elective offices specified under this act.”
