Suspended Kano anti-corruption boss raises fresh motion against IGP, Speaker, others

The suspended Chairman of Kano Public Complaints and Anti-corruption Commission, Barr. Muhuyi Magagi Rimin-Gado, yesterday, sought order of the Federal High Court sitting in Kano to restrain the Inspector General of Police (IGP) Usman Baba Alkali; Speaker, Kano State House of Assembly, Ibrahim Hamisu Chederi and four others, from arresting and harassing him.

Other respondents joined in the suit are Commissioner of Police, Kano; Kano State House of Assembly; Attorney General and Commissioner for Justice, Kano and Kano State Accountant General.

In a motion on notice filed before Justice Jane Inyang on Thursday, the embattled ex-anti-graft boss asked the court to direct the six respondents to maintain status quo against earlier judgement of the court, pending the hearing and determination of an appeal.

The motion filed through his counsel, Barr. R.O Zakariya, Muhuyi, urged an order of injunction, restraining the respondents, their agents, servant privies or anyone acting on their behalf, from carrying into effect or executing the judgement of the Federal High Court, delivered by Justice Inyang, pending the hearing and determination of the appeal.

Responding, counsel to the first, second, third and fourth defendants, Barr. A.A. Wada, told the court that he has filed counter-affidafit and written documents in response to the motion.

Justice Inyang, had on March 1, 2022, held a judgement against Muhuyi’s earlier exparte application. In her judgement, Justice Inyang ruled that IGP and Commissioner of Police in Kano possessed the constitutional right to investigate and arrest the anti-corruption boss.

Although, Muhuyi has refused to move application for stay of execution on the judgement of March 1, 2022, the motion on notice raised on Thursday, asking the same Judge to give injunction and order mandating status quo upon its judgement, may amount to ‘functus officio’. Nevertheless, Justice Inyang has reserved the case to March 28, 2022 for hearing of other motions and ruling on all applications.

Muhuyi is facing alleged criminal trial of fake medical certificate, raised during the investigative panel constituted by the State House of Assembly.

The anti-corruption crusader, who had claimed the commission remain an independent institution, should be devoid of interference, continued to challenge his removal by Governor Abdullahi Umar Ganduje.
