Tribunal Dismisses Labour Party’s Petition Against Governor

THE governorship electoral tribunal sitting in Calabar yesterday dismissed the petition filed by Mr. Fidelis Ugbo of Labour Party against the Peoples Democratic Party (PDP) and Governor Ben Ayade over election irregularities.

The petitioner had filed an application July 2, 2015 seeking the dismissal of the case filed through the election petition tribunal on April 30, 2015, seeking the nullification of the 2015 governorship election in which Ayade defeated Ugbo.

At the April 11, 4015 general election, Prof. Ben Ayade polled 342,016 votes to defeat Ntufam Ugbo of the Labour Party who polled 36,918 votes to emerge third. But in a turn of events, the Labour Party and its candidate filed a motion seeing to withdraw the case and prayed that the court should strike out the matter.

In an application submitted to the Governorship/State Houses of Assembly Tribunal headed by Justice Mohammed Aliyu Mayaki, the petitioner and lead counsel to Fidelis Ugbo, Mr. Bolutife Olusegun, had sought the withdrawal of the matter. Olusegun argued that the withdrawal was for the unity, peace and overall development of the entire state.

He, therefore, appealed to the court to dismiss the case, maintaining that it had received an affidavit of the second and third respondents, which became necessary for the dismissal of the case. While giving ruling at the Federal High Court in Calabar, the presiding Judge, Justice Aliyu Mayaki said that “the case lacks merit and substance” and, therefore, dismissed it.
