
Chairman of Alliance on Surviving COVID-19 and Beyond, Femi Falana, has called on former governors to stop drawing from their states. The senior lawyer urged them to emulate Gbenga Daniel and Ibrahim Dankwanbo, who once held sway in Ogun and Gombe states. He said since the Houses of Assembly of Kwara, Imo and Zamfara states have abolished the Governors Pension Scheme, asking others to follow suit.
Falana also referred to the judgment delivered on November 26 2019 by Justice Oluremi Oguntoyinbo (now retired) regarding the development as unconstitutional.
The plaintiff, Socio-Economic Rights and Accountability Project (SERAP) had filed the suit against the Attorney-General of the Federation) wherein it challenged the constitutional validity of the payment.
The judge, in the suit marked number FHC/L/CS/1497/2017, declared the payment illegal and unconstitutional. Consequently, he ordered the Accountant-General of the Federation and Minister of Justice to recover life pensions to ex-governors serving as senators and ministers.
Falana also cited a similar suit marked NICN/JOS/26/2016 between Garba Umar against Taraba State government, wherein Justice K. I. Amadi of the National Industrial Court of Nigeria (NICN) declared as null and void the payment of pension and gratuity to former governors and deputy governors.
He noted that, in compliance with both judgments, Senators Daniel and Dankwambo have requested the governors of Ogun and Gombe States to stop paying them perks.
