How to hire in the United States: contractors vs employees for Nigerian businesses

Key takeaways

  • Before deciding how to hire in the United States, describe the work, how it will be managed and the worker’s actual state and locality. Those facts guide the assessment of the relationship and applicable obligations.
  • Independent services can meet a defined project need; employment can support continuing responsibility within the business. Neither a short assignment nor remote working settles worker classification.
  • Compare the complete cost of the same work. Contractor compensation and platform charges belong in one budget; employee pay, employer obligations and administration belong in another.
  • Confirm the provider’s exact product, contracting parties and eligibility in writing. A country on a coverage list does not establish that it accepts a particular Nigerian client or US role.

Start with the work the US-based person will do

A Nigerian business might need a report based on interviews with US customers, organized independently by a specialist. Or it might need someone to maintain customer relationships under a manager’s weekly priorities. These hypothetical requests involve US-based expertise, but call for different working arrangements.

For the report, define the questions, output and acceptance process, then assess whether the working relationship supports an independent service. Agree on the scope of follow-up interviews and handover. Employment can suit ongoing responsibility where the business needs continuity and manages the work. It also brings recurring employment administration to budget and organize.

Neither example settles classification. A deliverable does not establish independence, and the job title does not answer the legal question.

Write a brief covering:

  • Work and responsibility: the output, continuing duties, expected duration and who accepts the result.
  • Direction: who decides methods, working hours and day-to-day priorities.
  • Business arrangements: tools, expenses, other clients and how the person conducts their own business.
  • Location: the state and locality where the person actually works.

The IRS groups federal employment-tax considerations into behavioral control, financial control and the type of relationship. It considers the relationship as a whole; there is no numerical scorecard. Working from home does not establish contractor status.

Federal tax guidance is only part of the review. Applicable wage-law and state requirements need separate assessment. California, for example, uses an ABC framework in many situations, with exceptions and alternative tests for some occupations and relationships. The applicable rules depend on the actual work and location; California is not a national template.

Keep the brief alongside the agreement. If the report assignment becomes a continuing customer role with management-set priorities, review the arrangement before extending it. Changing the invoice description would not address how the work now runs.

Identify who will employ the person

With direct employment, identify the employing entity and arrange the registrations, payroll, tax and employment administration applicable to the work location. A Nigerian business needs advice on its own circumstances before assuming it can employ directly through its existing entity.

When evaluating an employer of record in the United States, check which entity signs the employment agreement, whether it covers the state and role, and which responsibilities remain with the client. Under this EOR model, the provider’s employing entity signs the employment agreement and administers payroll and benefits. The client manages the work.

A US professional employer organization, or PEO, typically uses co-employment with an existing employer. Deel’s PEO, for example, identifies a US legal entity as a fit requirement. That co-employment structure differs from the EOR model.

Payroll outsourcing supplies administration to an employer. The IRS says using an ordinary payroll service provider does not remove the employer’s responsibility to ensure federal employment-tax obligations are met. Other third-party arrangements can allocate tax responsibilities differently.

For the hypothetical ongoing customer role, ask who employs, who files, who funds obligations and who handles changes or exit. The business also needs a separate corporate-tax review of its US activities; a workforce-service agreement does not resolve those questions.

Contractor operations address a different relationship. The 4dev.com Contractor Platform is not an employee EOR or employee-payroll product.

Compare the whole cost of the same work

A contractor’s project price and an employee’s monthly salary cover different commitments. Use the role brief to request quotes for suitable arrangements, including the costs of administering each one.

For a contractor arrangement, check:

  • Agreed services: compensation for the defined output, revisions and any continuing work.
  • Provider charges: the platform or contractor-service fee, its calculation base and included services.
  • Preparation: classification review, agreement review and onboarding work where needed.
  • Working resources: tools, access and expenses the business agrees to fund.
  • Payment and reporting: applicable transaction and currency-conversion charges, tax-document work and reporting administration.
  • Completion: scope changes, handover and any agreed rights-transfer arrangements.

For an employee arrangement, check:

  • Gross remuneration: pay for the agreed role and working period.
  • Employer obligations: employer tax amounts and unemployment obligations where applicable.
  • Insurance and benefits: required or agreed coverage, benefits and leave provisions for that location and arrangement.
  • Recruitment and resources: hiring costs, equipment and access.
  • Administration: payroll, HR and legal work, plus an EOR charge if that route is selected.
  • Exit: applicable contractual or employment-related obligations when the relationship ends.

Check which items apply to the proposed arrangement. Employee taxes withheld from gross pay are different from employer tax expense; adding them again on top of gross salary overstates the budget. Ordinary salary paid during leave should not be counted twice either.

Separate one-off setup, recurring expense and cash tied up in refundable deposits or reserves. A refundable deposit can affect available cash without being the same kind of cost as a monthly fee.

For the hypothetical interview report, specify whether follow-up interviews and a handover session are included. For the ongoing customer role, specify the period, responsibilities and administration covered. Request each quote in the same currency, with exclusions listed. A usage-based percentage and a monthly per-contractor charge require their own calculation bases before either becomes a meaningful total.

Three providers for a contractor shortlist

For an appropriate independent-service arrangement, compare these three candidates by contracting model, records and fee basis. Start with the agreement: it determines which product is being quoted and the responsibilities it covers. A contractor-service quote does not establish worker status or include the provider’s separate employee services.

4dev.com

  • Model: The 4dev.com Contractor Platform focuses on contractor operations. The client signs a B2B agreement with 4dev.com, which acts as general contractor and engages freelancers as subcontractors.
  • Workflow: It advertises verification, task/status records and document generation and storage. Documents vary by country; any rights transfer depends on the selected task arrangements and governing agreements.
  • Cost: Usage-based service fees apply to completed contractor workflows. Request the calculation base, included services, volume terms and charges outside the platform fee.
  • Limits: Its published emphasis is software, remote IT and digital/creative work. It has no employee EOR or employee payroll. The US country listing does not confirm acceptance of a Nigerian payer or either hypothetical role; obtain the applicable service agreement and scoped confirmation.

Deel

  • Model: Deel describes its Contractor of Record arrangement as a master services agreement and statement of work with the client, plus a Deel agreement with the contractor. Location, role and work setup undergo eligibility review.
  • Workflow: Deel publicly offers US contractor contracting, document and payment workflows. Confirm which records and administrative tasks the selected Contractor of Record agreement includes.
  • Cost: The advertised Contractor of Record fee is monthly per contractor; its FAQ also describes a deposit. Request compensation, deposit timing and other charges separately.
  • Limits: Ordinary Contractor Management has a separate, lower fee; that fee does not price the Contractor of Record arrangement. Separate employee products are outside this contractor quote. Confirm acceptance of the Nigerian entity, US work state and funding route.

Remote

  • Model: Remote says its Contractor of Record service contracts with and pays the contractor directly. Request the agreement identifying the legal entity for the proposed engagement.
  • Workflow: Its separate Contractor Management product leaves the contractor agreement with the client and includes localized contract creation/signing, invoice approval and payment administration. Identify which model the business wants before requesting terms.
  • Cost: Contractor of Record has a monthly per-contractor starting price. Contractor Management has its own active-contractor monthly charge. Budget for contractor compensation and other project costs separately from either fee.
  • Limits: Remote’s US Contractor Management payment listing does not establish US Contractor of Record eligibility. Billing currency and contractor-bank location affect payment availability. Confirm the Nigerian client, exact product, state and role; employee services require a separate scope.

Ask all three to confirm the contracting parties, currency and bank route, fee exclusions and responsibilities for changes, disputes and exit in writing.

Questions to settle before hiring in the United States

Can a Nigerian company engage a US-based person?

The route requires assessment of the client entity, actual work and location. Establish whether the relationship should be employment or independent services, then confirm the relevant legal and administrative arrangements. A provider’s US country listing does not establish Nigerian-client acceptance. Direct employment also requires advice on applicable registrations and the foreign business’s tax position.

Does a contractor agreement settle status?

No. For federal employment-tax purposes, the IRS considers behavioral control, financial control and the relationship together. The contract label and remote location do not decide the outcome. Applicable wage-law and state requirements need their own review. Record how the work will actually run, then check whether the agreement and working practices support the proposed arrangement.

Is an EOR the same as payroll outsourcing?

No. In the EOR model described here, the provider’s employing entity signs the employment arrangement and administers payroll and benefits while the client directs the work. Ordinary payroll outsourcing processes administration for an employer. Ask which entity employs, which obligations the agreement allocates and what remains with the client; other third-party tax arrangements have different rules.

Is a contractor always cheaper than an employee?

No. Headline fees do not establish the total cost. Compare the same work over the same period, including compensation, applicable employer obligations, provider charges, tools and administration. Distinguish refundable cash requirements from expense. For the interview-report example, an initial project price also needs a clear boundary around revisions and follow-up work before it can support a budget.

What changes require a fresh review?

Revisit the arrangement when duties, direction, location or the nature of the relationship change. If an independent report becomes continuing customer management, reassess status and the provider’s service scope. Update the one-page role brief, identify who will handle the changed obligations and obtain a revised written quote covering the work, period, currency and exclusions.
