Court strikes out contempt charge against Ecobank
A Federal High Court, Lagos sitting before Justice Ibrahim Idris last weekend struck out a contempt charge filed against Ecobank Nigeria Limited.
The charge was filed by Honeywell Flour Mills Plc.
The trial judge in striking out the charge held that the contempt charges were not properly served on the alleged contemnors.
He therefore declined jurisdiction, but directed parties to maintain status quo until the order is set aside by the Court of Appeal.
The judge said a party seeking to jail another for disobeying a court order was duty bound to ensure that processes in contempt proceedings were duly served.
Earlier, Ecobank had failed in its bid to halt the ruling, citing it’s notice of appeal.
In his ruling, Justice Idris rejected Ecobank’s application for stay. This followed an earlier ruling by Justice Idris on December 11, 2015 that the court has jurisdiction to entertain the contempt proceedings instituted by Honeywell.
