
The Owerri Appeal Court, presided over by Justice Jimmy Bada, yesterday dismissed the motion brought before it by the governorship candidate of the All Progressives Grand Alliance (APGA), Alex Otti.
Otti, through his lawyer, Kalu Awa, SAN, had argued that the applicant had 14 days, according to the Electoral Act, to file a motion to grant him seven days to call witnesses.
But Counsel to the Abia State Governor, Okezie Ikpeazu, and the Independent National Electoral Commission (INEC), Dr. Livy Uzuokwu, SAN and Chief Onyichi Ikpeazu, SAN, representing INEC and the Peoples Democratic Party (PDP), supported the argument by Chief Wale Olanipekun, SAN to discountenance Otti’s motion to be allowed to produce more witnesses.
Kalu, had argued, last week, that the lower court had on July 27 granted a motion from the respondent after the same status court had ruled on July 24 that no further motion would be taken.
The parties consented to the ruling of the appeal court.
