Ekiti State Commissioner for Justice and Attorney-General, Mr. Owoseni Ajayi has disagreed with Minister of Justice, Abubakar Malami, on a plan to reopen some murder cases during the first tenure of Governor Ayodele Fayose.
He described the plan as “futile” and an attempt to chase shadows because the cases had been concluded by the police in the state, as well as the Force Headquarters in Abuja.
Owoseni, who spoke in Ado-Ekiti yesterday, said murder cases of Dr. Ayo Daramola and Mr. Tunde Omojola had been thoroughly investigated and concluded by police authorities.
He said those indicted had long been charged to court and some among them had either been discharged and acquitted. Owoseni added that there was nothing to Investigate, saying the cases had been concluded.
In another development, Owoseni said that the allegation of certificate forgery by some members of the House of Assembly was also a mere propaganda, as no lawmaker had been indicted or invited for interrogation.
He said under the law of the country, the Department of State Security (DSS) could only arrest, but lacked the power to investigate, charge suspects to court or prosecute.
He added that the DSS could only turn such suspects to the police, the Economic and Financial Crimes Commission (EFCC), the Independent Corrupt Practices and other related offences Commission (ICPC) as the case might be.
Owoseni, therefore, said the Minister of Justice also lacked the power to prosecute.
