The Department of State Services (DSS) has closed its case against former Kaduna State Governor, Nasir el-Rufai, in the alleged wiretapping case before the Federal High Court in Abuja.
At the resumed hearing yesterday, prosecuting counsel, Oluwole Aladedoye, informed the court that the prosecution would not be presenting any further witnesses, effectively bringing its case to a close.
Following the development, counsel to el-Rufai, Paul Erokoro, told the court that the defence would file a no-case submission, arguing that the prosecution had failed to establish a prima facie case against the former governor.
The defence requested two weeks to file the application, while the prosecution also sought two weeks to respond.
The defence further applied for a variation of the bail conditions earlier granted to el-Rufai, describing the requirements as harsh and difficult to satisfy.
Erokoro specifically challenged the conditions requiring two level 17 civil servants with landed property in Maitama or Asokoro to stand as sureties, along with verification and attestation letters from the Kaduna State Traditional Council.
The prosecution opposed the application, arguing that public officers were available to meet the bail conditions and urging the court to reject the request.
In her ruling, Justice Joyce Abdulmalik declined to vary the bail terms, holding that civil servants who meet the stated requirements exist.
The court adjourned the matter until September 22 to file the no-case submission and for further proceedings.
