Ganduje defeats Abba at Appeal Court

The Court of Appeal sitting in Kaduna on Friday declared Governor Abdullahi Umar Ganduje as winner of the March governorship election in the state.

In a unanimous judgment delivered by Justice Tijjani Abubakar, the Appeal court dismissed the appeal of the governorship candidate of Peoples Democratic Party (PDP), Abba Kabiru Yusuf for lack of merit.

Justice Tijjani stroke out the appellant six appeals and affirmed the ruling of Kano governorship election petition tribunal delivered by Justice Halima Mohammad Shamaki of 2nd of Oct, 2019, which declared Ganduje winner of the 9th and 23rd March 2019, governorship election.

The PDP has appealed the declaration of the tribunal on six counts, claiming the APC candidate did not win the highest lawful votes, insisted the March 23rd rerun was unlawful considered by the Independent National Electoral Commission (INEC) and that, the process of the elections were characterized with irregularities.

But the court maintained that the appellant has not show sufficient reason why the upper court should nullify the victory of the APC candidate and Governor Ganduje.

Ganduje was declared winner with an average marginal difference of 8,982 votes against the candidate of the main opposition PDP.

Declaring the merge results of the 9th and 23rd March results, the state returning officer, Professor Bello B. Shehu said the APC candidate polled 1,033,695 votes to defeated the PDP candidate who scored 1,024,713 votes.
