
Dr. Albert Ndulue, an 84-year old retired gynecologist has demanded N1billion compensation from NICON Trustees limited and its receiver/manager, Mr. Abah Onah, following alleged vandalisation of his property by some hoodlums at his behest.
Ndulue, yesterday in Lekki, Lagos, lamented that since five years he has been subjected to all manner of mental torture, trauma and unbelievable injustice as a result of the unending onslaught against his property at plot 8, Block 24, Alma Estate, Lekki, Eti-Osa, Lagos by the suspects.
He stated that he paid for the land in 1991 from Alma beach, when the property was still under sand-filling. Finally in 1993, Alma beach allocated a plot of land measuring 1,358.974 square metres to him.
His words: “Following this allocation, I went to Alma Beach to request for the documents required by the Lagos State government to regularise the purchase of the land, obtain governor’s consent and perfect my title. I was informed that Wale Babalakin (SAN) had taken over Alma beach estate and was responsible for providing the requested documents.
“I approached Babalakin who refused to give me the documents, but instead offered to give me N12million, which I rejected. Following his refusal, I sued Alma beach estate at the Lagos high court.”
After the court had ruled in his favour, the firm gave him all the required documents, which he used to obtain governor’s consent, and submitted a building plan to the Lagos Physical Planning and Urban Development Authority.
According to him, the Authority approved his plan in 2014 and he commenced construction with a fence round the land.
He explained that while still building, he discovered a notice pasted on his property, which was a case of an interim order of receivership in suit No FHC/L/CS/1242//2017 before a Federal High Court, Lagos.
He said the court eventually found the suit to be fraudulent and incompetent and dismissed it on June 18, 2018.
Consequently, he continued the development of his property to almost completion, but in 2021 while away on medical vacation, he got a call from a neighbour that his property had been vandalised by some thugs and put up for sale.
“It was discovered that it was the same characters, who were parties to the interim suit already dismissed by the court, that were responsible for the attempted sale of his property,” he said.
He said that since then, it has been a tug of war, as hoodlums recently invaded his property, and began looting and destroying the building, including the roofs, doors, windows, among others.
According to him, these elements are still relying on the interim order, which had already been struck out for being fraudulent.
He alleged that the other party had proceeded to Zone 2 police station and misrepresented facts to the AIG that they had gotten final judgment to take over the property.
Ndulue said that all efforts to invite the police over the issue to hear their part of the story have remained unyielding.
