The prolonged leadership crisis rocking the Action Alliance (AA) took another twist on Tuesday as the party’s National Chairman, Chief Kenneth Udeze, hailed the decision of the Court of Appeal sitting in Akure granting his application to withdraw as an interested party in an appeal challenging his leadership.
Udeze said his decision to disengage from the proceedings was based on the conviction that the legal issues surrounding the party’s leadership had already been settled by several subsisting judgments of the Court of Appeal affirming him as the authentic National Chairman of the Action Alliance.
The AA chairman had approached the appellate court through two motions on notice, CA/AK/268M/2025 and CA/AK/309M/2025, seeking leave to withdraw as an interested party in the appeal.
According to him, the appeal originated from the judgment of the Federal High Court, Osogbo Division, in Suit No. FHC/OS/CS/34/2025, delivered on September 29, 2025. He argued that the issues canvassed in the matter had become academic in view of existing appellate court decisions that had consistently recognised his leadership of the party.
Udeze maintained that judgments of the Court of Appeal remain binding on all individuals, institutions and authorities across the country unless overturned by the Supreme Court, stressing that a decision of a lower court cannot invalidate or supersede the pronouncements of a superior court.
He also drew attention to the pending appeal before the Supreme Court in Appeal No. SC/CV/162/2024, filed by Adekunle Rufai Omoaje and others against Chief Uzewuru Nwachukwu and others, which seeks to challenge the judgment of the Court of Appeal, Abuja Division, delivered on January 26, 2024.
According to Udeze, the Abuja Division’s judgment, alongside other appellate court decisions, unequivocally affirmed him as the authentic and lawful National Chairman of the Action Alliance.
The party has witnessed a series of legal battles over its leadership in recent years, with rival factions laying claim to the national chairmanship and seeking judicial validation of their positions. The disputes have resulted in multiple court actions across different jurisdictions, although Udeze insists that the appellate courts have consistently upheld his leadership.
He expressed confidence that the latest development further reinforces the legal standing of his leadership pending the final determination of the matter by the Supreme Court, urging party members to remain united and focus on strengthening the party ahead of future political activities.
