ANLCA trustees risk committal for alleged disobedience to court order

Federal High Court, Lagos State.

A committal to prison action has been filed at the Federal High Court, Lagos against the Trustees of Association of Nigeria Licensed Customs Agents (ANLCA) for refusing to comply with court order.

The court had ordered the reinstatement of Mr Bola Asiru Balogun, a supposed winner of ANLCA election.

Joined in the contempt proceeding are chairman, ASECO, Mr Anokwuru Alloy, Bamgbala Abayomi Adejare and Batolab Investment Nigeria Limited.

Others are Taiwo Mustafa, Kingsley Ofor, Kayode Farinto, Babatunde Mukaila, Ozo Chukwura, Aloy Igwe, Ernest Elochukwu, Igbaruola Eniola, Samsondeen Awopeju, Denis Okafor and Dayo Azeez.

In the form 48, which is the notice of the consequence of disobedience of court order, stated that unless they obey the order made on May 5, 2023 by Justice Peter Lifu, the court will commit them to prison.

Justice Lifu had on May 10, 2023 dismissed the notice of preliminary objection and the motion for stay of proceedings, pending arbitration against the judgment delivered on May 5, 2023.

The court had in the judgment declared Bola Ashiru Balogun as the authentic chairman of the chapter and nullified that of the incumbent, Bamgbala Adewusi.

The case is marked number FHC/L/CS/758/2022 between Bola Ashiru Balogun and his company, Sotofopy Nigeria Limited as the plaintiff, and the Board of Trustees of ANLCA, Mr Aloy Anokuru for himself and other members of ASECO as 1st and 2nd defendants.

Also, Bamgbala Adewusi and his company, Batolab Investment Nigeria Limited were the 3rd and 4th defendants.

The court held that the ANLCA chairman, Adewusi had been disqualified and ineligible to contest the January 15, 2022 election organised by the board or the Trustees.
