
The Court of Appeal sitting in Abuja, yesterday, removed Speaker of the Nasarawa State House of Assembly, Ibrahim Balarabe Abdullahi, a member of the All Progressives Congress (APC).
The court declared the Peoples Democratic Party (PDP) candidate, Sa’ad Abdullahi Ibrahim (Turakin-Opanda), as the rightful winner of the election for Umaisha/Ugya State Constituency.
The court also affirmed the election of Kefas Agbu as governor of Taraba State. In a unanimous judgment by a three-member panel of justices, delivered by Justice Peter Affen, the court held that the appellants, New Nigeria Peoples Party (NNPP) and its governorship candidate, Yahaya Sani, were not consistent in their petition against the March 18 governorship election.
It held that while NNPP and Sani prayed for nullification of the election on the ground of non-compliance with the Electoral Act, the duo, in another breath, asked the court to pronounce them winners for scoring majority of lawful votes.
The court held that it is against the law for any litigant to blow hot and cold at the same time. It, consequently, dismissed the appeal for lacking in merit.
