Court to rule December 1 on bail application of Kanu, others
Justice Binta Nyako of the Federal High Court, Abuja has fixed December 1 to decide on the bail applications filed by the detained leader of the Indigenous People of Biafra (IPOB), Nnamdi Kanu and three others.
They are standing trial on an 11-count charge bordering on treasonable felony, unlawful possession of firearms and terrorism.
When the matter came up yesterday, the defense counsel, Ifeanyi Ejiofor, while arguing the bail application prayed the court to admit Kanu to bail on liberal terms.
Ejiofor said the application was supported by a 26-paragraph affidavit and 35 exhibits, which include the charge filed against Kanu at the magistrate’s court, the ruling of the court granting him bail, the ruling of Justice Adeniyi Ademola of a Federal High Court in Abuja, ordering unconditional release of the Biafran leader.
Other documents attached to Kanu’s bail application include a newspaper publication of a statement by President Muhammadu Buhari that the first defendant (Kanu) will not be granted bail by any court and a certified true copy of Certificate of Incorporation of the Radio Biafra.
The counsel further informed the court that the first defendant had initiated a contempt proceedings against the Department of State Services (DSS) for refusing to obey an order of the court made last year, granting him bail.
The counsel to the second defendant, I. Adoga, also told the court that his client was still in custody of the DSS, instead of prison custody, as ordered by the court.
Counsel to the other defendants variously prayed the court to admit their clients to bail on liberal conditions.
After hearing submissions from counsels for and against the applications for the bail of Kanu and his co-defendants, Justice Nyako adjourned till December 1, to decide the application.
