The Nigerian Electricity Regulatory Commission (NERC) has officially transferred regulatory oversight of the electricity market in Plateau State to the Plateau State Electricity Regulatory Commission (PSERC).

This decision aligns with the amended Constitution of the Federal Republic of Nigeria and the Electricity Act (EA) 2023, which grants states the authority to regulate their intrastate electricity markets.

While NERC remains the central regulator for inter-state and international electricity generation, transmission, and supply, states can request regulatory control over electricity operations within their jurisdiction.

With this order, Plateau has joined states like Lagos, Imo, Ogun, Ondo, Ekiti, Enugu, Niger, Edo, and Oyo to regulate its electricity market.

Following compliance with the necessary legal requirements, the Plateau State Government formally notified NERC and requested the transfer, leading to the issuance of the regulatory order.

As part of the transfer process, NERC has directed Jos Electricity Distribution Plc (JED) to establish a subsidiary, JED SubCo, which will be responsible for the intrastate supply and distribution of electricity in Plateau State.

According to the Commission, JED has 60 days from March 12, 2025, to incorporate the subsidiary, which must then obtain the necessary license from PSERC.

All regulatory and operational transfers are expected to be completed by September 12, 2025.

“JED shall complete the incorporation of JED SubCo within 60 days from 12th March 2025. The subcompany shall apply for and obtain licence for the intrastate supply and distribution of electricity from NSERC, among other directives.

“All transfers envisaged by this order shall be completed by 12th September 2025.
The complete Order is on our website.”
