
Seid is younger brother of National Chairman of All Progressives Congress (APC) and former governor of the state, Adams Oshiomhole.
In the suit, the plaintiff through his counsel, Dele Igbinedion, said his constitutionally prescribed four-year term in office will expire on April 5, 2020.
The Peoples Democratic Party (PDP) lawmaker relied on subsisting court of Appeal judgment delivered on December 19, 2015 in his favour in Appeal No CA/EPT/ 343/3015 between Gallant Commander Sylvenus O.I. Eruaga V Dr. Gowon Marughu and five others.
He also prayed the court to determine whether the tenure of his office did not commence on April 5, 2016 when he subscribed to oath of office and allegiance on June 8, 2015 when the House of Assembly was inaugurated.
He, therefore, prayed the court for a perpetual injunction restraining Seid Oshiomhole from parading himself as member representing Etsako West Constituency ll, saying his seat was not vacant.
