Lack of prosecution team stalls terrorism case at Asaba Federal High Court

The alleged case of terrorism, attempted murder, and malicious damage instituted against the Iyase of Ogwashi Uku, Chief Michael Nwaukoni, and four others has again been stalled at the Federal High Court in Asaba, Delta State, due to the absence of the prosecution team.

Consequently, the presiding judge, Justice Olufumilola Agbaje, adjourned the case marked FHC/Asb/18C/24 till July 23, 2025.

Before the adjournment, however, Counsel to the 5th defendant in the case, Chief Efe Akpofure, made an oral bail application for his client, but Justice Agbaje said that the previous administration’s bail granted to the 5th defendant, Chief Michael Nwaukoni, is still valid till the next sitting.

Justice Agbaje therefore ordered the prosecution to serve the defence counsel with all the necessary court processes before the next adjourned date.

She also ordered that the further affidavit of the 5th defendant be served on the prosecution before the next adjourned date.

The defence team had informed the court of their readiness to go on with the case, but due to the absence of the prosecution team, the trial was not held.

The accused persons—National Legal Advisor of the Ogwashi-Uku Development Association (ODA), Francis Okolie Esq., Prince Eugene Ojo Izediunor, Agidiase Youth President, John Nwona, the Secretary General of the Ogwashi-Uku Development Association, Mazi Adigwe Eleumunor, and the Iyase of Ogwashi-Uku, Chief Michael Nwaukoni, being the 1st, 2nd, 3rd, 4th, and 5th defendants respectively – were present.
