Labour Party’s presidential candidate, Peter Obi, and the party have appealed the September 6, 2023 ruling of the Presidential Election Petition Court (PEPC).
A statement by National Publicity Secretary of the party, Obiora Ifoh, said Obi and LP’s team of lawyers, led by Dr Livy Uzokwu, were able to beat deadline for filing of the appeal.
He said Obi and his party are appealing on 51 grounds bordering on error in law, to prove that the All Progressives Congress (APC) presidential candidate, Bola Ahmed Tinubu, did not win the election.
They also averred that it was wrong for both Independent National Electoral Commission (INEC) and PEPC to declare Tinubu winner, when many incontrovertible points showed otherwise.
Obi and Labour Party asked the apex court to allow the appeal, set aside the perverse judgment of the PEPC, and grant the reliefs sought in the petition, either in the main or in the alternative.
On the issue of votes requirement for Abuja, Obi and Labour Party noted that PEPC failed to appreciate that for the President to assume his office or position of the governor of Abuja, he is also under a mandate to secure 25 per cent of ballots cast in the FCT.
They also accused PEPC of overlooking the fuller purport of Section 299, which they said will be more glaring on a calm examination of Section 301 of the Constitution. No date has been fixed for hearing of the case.
