Appeal Court reserves judgment in Kano guber appeal case

The Court of Appeal sitting in Abuja, yesterday, reserved judgment in the appeal filed by Kano State Governor, Abba Kabir Yusuf of the New Nigeria Peoples Party (NNPP) against the judgment of the tribunal that declared the All Progressives Congress (APC) candidate, Nasiru Yusuf Gawuna, winner of the governorship election.

Lead Counsel to the appellant, Wole Olanipekun (SAN), during the hearing of the appeal, yesterday, urged the court to set aside the decision of the tribunal in its entirety for lacking in merit.

Olanipekun said the tribunal had created new precedents that depart from all the judgments made by the appellate or Supreme Court, particularly on the issues of invalid ballots and qualification of party candidates.

He said that it is the first time in the history of the electoral trial where a court would overturn an election on the basis of non-signing of ballot papers.

The three-member panel of the court, reserved the judgment to a date that will be communicated to parties in the matter.
