Court strikes out N95.5m suit against businessman

The Lagos State Special Offences Court in Ikeja has struck out the N95.5 million suit filed by the police against an independent oil marketer, Bode Abamoda Omojuyigbe.

Omojuyigbe, 50, was charged in suit marked ID/21908C/23 by the police for allegedly obtaining petroleum products worth N95.591 million on credit by false pretence.

However, Hon. Justice Olubusola A. Okunuga discharged Omojuyigbe after the prosecution filed a notice to discontinue the case.

According to a Certified True Copy (CTC) of the ruling obtained by The Guardian, Omojuyigbe’s counsel, O. Onalaja, represented him when the matter came up on July 28, 2024.

The prosecutor, O. A. Bajulaiye-Bishi, represented Directorate of public prosecution for the state of Lagos.

Bajulaiye-Bishi, a senior state counsel informed the court of the state’s intention to take over the case.

She said: “The Police used to prosecute this case, but we got a petition in our office to take over this matter.

“We have written to the Police, and we have requested for the duplicate case file, and we are yet to receive the duplicate case file. I ask for a date.”

Addressing the parties, Justice Okunuga said: “There is a Notice of Discontinuance in the court’s file. Based on the Notice of Discontinuance dated March 21, 2024, signed by Mike E. Enejere of the Legal/Prosecution Section, Force CID Annex, Alagbon Close, Ikoyi, the Information is hereby struck out and the defendant is discharged accordingly.”
