Wife of ex-Delta council boss seeks dissolution of three-year-old marriage
Ubulu-Okiti District Customary Court in Aniocha South Local Council of Delta State will tomorrow (Tuesday) hear a suit filed by the wife of the immediate past chairman of Oshimili South Local Council, Mrs Uche MaryRose Ezenyili, against her husband, Dr Obi Kelvin Ezenyili, seeking dissolution of their three-year-old marriage.
The petitioner had approached the court for the dissolution of her marriage since she could no longer live together with the respondent as husband and wife.
The petitioner, in suit number UDCC/ 6/2024, averred that the marriage had broken down irretrievably and that both of them were incompatible as there was lack of love between them.
She further said through her counsel, Harry Ororho, that she had lived apart with the respondent for over two years, describing the respondent as unfriendly to live with.
She, therefore, prayed the court for an order to dissolve the marriage between her and the respondent, which was contracted on December 18, 2020, under Igbo Native Law and Custom.
The petitioner also prayed for an order of court granting custody of the only child of the marriage, Miss Rita-Frances Nnedinma Ezenyili, to her as well as an order granting her leave to refund the bride price of N10,000 to the respondent through the registry of the court.
The respondent, Dr Ezenyili, in a cross petition, said he was opposed to dissolution of the marriage.
The cross petitioner, through his counsel, Ariomagwha Medjor, affirmed that the marriage was contracted under Ihiala Native Law and Custom.
The case, which came up for hearing on April 30, 2024, was presided over by the chairman, Tumbó Tamaraukuro Jane, after which it was adjourned till tomorrow for further hearing.
